Terms and conditions

1. Scope of application

These terms and conditions apply to any orders that customers domiciled in Switzerland or Liechtenstein submit via the Boucherville AG online shop, via email, via fax or by post. By placing an order, the buyer agrees to the terms and conditions of Boucherville AG.

The law prohibits the sale of spirits, aperitifs and alcopops to people under the age of 18 as well as wine, beer and cider to people under the age of 16. Purchases via the online shop are possible for people aged 18 or over. For all orders subject to age-related restrictions, we use a reliable method to verify the identity and age of the person placing the order and thus ensure that said individual is of the minimum legal age. The delivery of any such order is dependent on carrying out this check, and we will only deliver to the individual making the order.

2. Conclusion of sale

The presentation of products in the online shop does not constitute a legally binding offer. Orders are deemed to constitute offers to make a purchase. By clicking the order button "confirm purchase", the customer places a binding order for the products included in the shopping basket. Boucherville AG will acknowledge receipt of the order via an automated email (order confirmation). The sale is concluded when Boucherville AG sends an email confirming shipment of the item or items (confirmation of order/shipment), or, at the very latest, once the item or items has or have been dispatched.

In the case of payment up front, the sale is concluded when Boucherville AG confirms receipt of such payment.

3. Prices

All prices are stated per item in Swiss francs including 8.1% VAT. Prices and vintages are subject to change. Price errors reserved. All products are for sale while stocks last.

4. Discounts

Discount if you buy in bulk:
From 36 bottles: 3%
From 60 bottles: 4%
From 96 bottles: 5%

Discounts cannot be combined, be it with other discounts or promotional discounts. Discounts do not apply to spirits, rare wines and net items.

5. Delivery

Delivery within Switzerland and the Principality of Liechtenstein is free of charge if you purchase 12 bottles or more, or if your order is worth at least CHF 199. Otherwise, we apply shipping costs of CHF 12.

All orders will be shipped via Planzer to your address within two working days. If an e-mail address or mobile number is known, the addressee will be informed about the status of the delivery and has the opportunity to control the delivery.

Express deliveries and costs on request.

No deliveries abroad.

6. Returns/misdeliveries

Unfortunately, we cannot accept the return or exchange of wines that are not faulty. If your order goes missing between dispatch and delivery, we will send you a replacement order.

If a wine that you buy from us is corked or otherwise faulty, we will issue you with a replacement bottle. Simply return to our wine shop with the original purchase or call us on 044 299 40 30. Please note that the wine must have been purchased from us within the last 12 months and still be at least two thirds full. This policy does not apply to any of our ports or rare wines.

7. Payment/credit worthiness

All invoices are payable in full within the 30 days of the relevant invoice date. All goods remain the property of Boucherville AG until paid for in full.

For security reasons, we require all new customers to pay for their first order up front via invoice or via credit card (Mastercard or Visa). We ship all orders immediately on receipt of payment.

To ensure payment, the necessary data, in particular your personal details, may also be transmitted to a credit agency for the automated assessment of your creditworthiness. In this context, the credit agency may assign you a so-called score value. This is an estimate of the future risk of non-payment, e.g. based on a percentage. The value is collected using mathematical-statistical methods and including data from the credit agency from other sources. We reserve the right, according to the information received, not to offer you the payment method "invoice". The legal basis for this data processing is our legitimate interest according to Art.

8. Late payment / payment reminders / payment recovery

In the case of payment against invoice, the purchase price must be settled within 30 days of the item or items being delivered. The customer will default if the payment has not been settled within this time. In the event of the customer defaulting on payment, Boucherville AG may send the customer up to three written payment reminders. The following reminder fees apply:

First reminder after 30 days CHF 10
Second reminder after 60 days CHF 20
Final reminder after 90 days CHF 30

In addition to these reminder fees, default interest in the amount of 1% will also be payable from the due date. If the outstanding amount has still not been settled after the final reminder, the competent enforcement authority will be entrusted with recovering the debt.

9. Validity

These terms and conditions may be changed at any time without notice.

10. Applicable law and jurisdiction

All sales concluded or business relationships entered into with Boucherville AG are subject to Swiss law. The place of jurisdiction is Zurich.
